The Supreme Court has accepted eBay’s appeal in a patent case. A federal court jury, in 2003, found that eBay was violating three patents which were owned by MercExchange.


The Supreme Court has accepted eBay’s appeal in a patent case. A federal court jury, in 2003, found that eBay was violating three patents which were owned by MercExchange.

The patents in question allowed eBay to process transactions for its fixed-price purchasing feature.

Judge Jerome B. Friedman of the Federal District Court, said, “MercExchange exists solely to license its patents or sue to enforce its patents, and not to develop or commercialize them.” [Source]

The Judge refused to issue an injunction which will stop eBay from using patented methods in their operations.
